What is a Trust?
A trust is a legal structure that can be set up in life or on death. Simply put, the person making the gift (settlor) transfers assets to the trustees of the trust for the benefit of the beneficiaries.
The legal ownership sits with the trustees not the beneficiaries. This is different to an outright gift where the ownership sits with the beneficiary, where problems can arise if that person were; not yet an adult, to divorce, die, be made bankrupt, or receive means tested benefits.
What is Estate Planning?
Every family is different, the dynamic between members varies from family to family. This means that there is not one universal solution on how best to plan your estate both during your life and after your death.
Complexities can and will arise throughout life and this can result in conflict in both family and business relationships.
The world is rapidly changing and becoming increasingly complex. Families wish to ensure that future generations are looked after. This is why BLM has created our estate and legacy planning service to enable you to see the path ahead clearly.
At the heart of this process is inter-generational planning, we will work in collaboration with you and your existing advisers (or if appropriate refer you to people we trust) to ensure that your needs and priorities are met. We will assist you in establishing your estate plan and will give you bespoke advice regarding legacy and succession issues rather than simply providing you with standard advice.
We will ensure that your estate plan puts measures in place to ensure that your affairs will be looked after during your lifetime (through wealth management and Lasting Powers of Attorney) and that future generations of your family will be provided for after your death through appropriate legacy planning.
